DH International Ltée (hereinafter "DHI") is the licensee to use the MoneyCell brand in Canada. Consequently, any reference to MoneyCell in these terms of use will also be a reference to DHI, depending on the context. As soon as you use the MoneyCell site (the “Site”), you agree to do so under the conditions indicated below. MoneyCell reserves the right to modify these conditions without notice, so that you are requested to consult these conditions of use periodically. Simple access to the Site will be considered as acceptance of the conditions of use then in force.
MoneyCell reserves the right to end the conditions of use as well as your right to browse the Site or part of it, even without notice.
All texts, illustrations, images, photographs, information, software and codes available on the Site, including the presentation of the various elements, are protected by Canadian and foreign laws relating to intellectual property, specifically but without limitation, in terms of Copyright. They belong either to DHI, or to its licensors or to any person providing content. You agree to respect all copyright and other intellectual property rights which you may access through the Site. You have only a non-exclusive and non-transferable license to use and display the Site on your computer or other electronic device and only for the purposes of representation on a single-user screen and the creation of a single electronic backup copy or in paper print. No commercial use may be made of the intellectual property rights arising from the material contained on the Site. This Site only allows personal use and any modification, reproduction, distribution, transmission, dissemination, representation, networking, marketing, publication, public performance, creation of a derivative work, display on the internet or other Operation of the same type is strictly prohibited. Nothing on the Site can be interpreted as giving you a right other than that of a personal user. Certain names, graphics, logos, icons, designs, words, titles or phrases used on the Site may constitute trademarks of DHI or of third parties. Some are registered trademarks in Canada or other countries. However, the use of these brands on the Site does not necessarily constitute a representation to the effect that a user license has been granted to DHI.
The Site is governed by the laws of Quebec and the federal laws of Canada applicable there. Any litigation, dispute or complaint resulting from the use of the Site or relating to it will be subject to these laws without regard to the principles of conflicts of laws and will come under the exclusive jurisdiction of the courts of Quebec.
As a user of the Site, you agree to use it diligently and with discernment and you agree to comply with applicable laws and usual safety standards.
The Site, its functionality and its content are provided as is and as available. Your use of the Site and its features is at your own risk, MoneyCell making no representation or warranty as to the content of the Site or the features. MoneyCell makes no representation 1 ° as to the merchantability, the suitability for a particular use and the violation of intellectual property rights, 2 ° as for the safe and uninterrupted functioning of the Site, 3 ° as for the accuracy, exhaustiveness, reliability or relevance of the elements contained on the Site, or 4 ° as for the correction of faults or errors on the Site or the functionality of the Site, the absence of viruses or harmful elements on the Site or in its functionality or the secure transmission without interception of communications via the Site or its functionality. Although MoneyCell encourages hyperlinks in general, it does not wish to be linked to any other site that contains content or encourages conduct that would constitute a criminal offense, result in civil liability or violate any law or regulation or that contravenes the moral standards of Canadian society or that carries a violation or transgression of the rights of others. Certain features of the Site require registration. MoneyCell may ask you to register and provide personal information. MoneyCell is not responsible for any damage you may suffer from the unauthorized or illegal use of your NFC username, password or sticker. You agree to notify MoneyCell of any unauthorized or non-compliant use of your user name, password and / or NFC sticker.
MoneyCell, while not required to do so, will apply reasonable security measures and will impose them on its service providers to prevent personal information about you from being shared, used or collected by a malicious third party. You acknowledge that MoneyCell is limited in the area of security and privacy and that these limits are beyond the control of MoneyCell. Consequently, MoneyCell cannot guarantee the security, integrity and confidentiality of the information and data exchanged between you and MoneyCell through the Site, by email or by any other means of electronic communication whatsoever. Consequently, you acknowledge that MoneyCell has no responsibility for damage, loss or cost that you may suffer as a result of the interception and malicious use of your personal information or data transmitted over the internet.
MoneyCell does not guarantee the accuracy, compliance or completeness of the data and information contained on the Site, whether these come from MoneyCell or from other sources. There is, therefore, no guarantee that they are accurate, complete, free from error or omission or that they are relevant or up to date at any time. This data and information can be modified, replaced or removed at any time upon decision of MoneyCell.
